  8. NeXT Announces Beta Program for DPT 2000 Series Driver Update

  11. NeXT will ship a beta version of the updated DPT 2000 series
  12.  
  13. driver on Friday, May 20.  In order to participate in the beta
  14.  
  15. test, simply fill out the form below and return to
  16.  
  17. darren_smith@next.com.  (Note:  You MUST have the ability to send
  18.  
  19. and receive NeXTMail in order to participate in the beta program.
  20.  
  21. This beta driver will ONLY be distributed in electronic form.)

  44. This Agreement sets forth the terms under which a release of the
  45.  
  46. NeXT software described below, including documentation and other
  47.  
  48. materials provided with such software ("NeXT Software") is being
  49.  
  50. provided to you. Please read this Agreement, and if you do not
  51.  
  52. agree to be bound by its terms, promptly return the NeXT Software
  53.  
  54. to NeXT.

  56. 1.  Software License Grant.  NeXT grants you a nonexclusive,
  57.  
  58. nontransferable, royalty-free license to use the NeXT Software for
  59.  
  60. the sole purpose of beta testing the NeXT Software.  You may not
  61.  
  62. copy the NeXT Software except to make a single archival copy.  You
  63.  
  64. acknowledge that the NeXT Software contains copyrights, trade
  65.  
  66. secrets and proprietary rights of NeXT and its third party
  67.  
  68. suppliers and you may not use the NeXT Software, or trade secret,
  69.  
  70. confidential or proprietary information contained in the NeXT
  71.  
  72. Software in any product developed by You or on Your behalf.
  73.  
  74. Accordingly, you agree not to remove or destroy any copyright or
  75.  
  76. other proprietary rights notices contained on or in the NeXT
  77.  
  78. Software
  79.  
  80. 2.  No Warranty; No Support.  The NeXT Software is delivered "AS
  81.  
  82. IS".  NeXT does not warrant that the operation of the NeXT
  83.  
  84. Software will be uninterrupted or error-free, that any NeXT
  85.  
  86. Software errors will be corrected, that the NeXT Software will
  87.  
  88. satisfy your requirements, or that the NeXT Software will operate
  89.  
  90. in the combinations which you may select for use.  In addition,
  91.  
  92. NeXT DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED,

  94. INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS

  96. FOR A PARTICULAR PURPOSE.

  99. 3.  Feedback to NeXT.  You agree that, to the extent you generate

  101. or collect data in connection with the use of the NeXT Software

  103. under this Agreement, you will furnish to NeXT a copy of such
  104.  
  105. information for the purpose of providing NeXT the benefit of your
  106.  
  107. experience with respect to the use of the NeXT Software.  You
  108.  
  109. further agree to promptly report any bugs or errors you may
  110.  
  111. discover in using the NeXT Software and, in any event, to deliver
  112.  
  113. all final bug or error reports to NeXT in writing not later than
  114.  
  115. July 1, 1994.

  117. 4.  U.S. Government Licensees.  If the NeXT Software is acquired
  118.  
  119. by or on behalf of a unit or agency of the United States
  120.  
  121. Government, the following provisions apply. The NeXT Software (a)
  122.  
  123. is existing computer software and was developed at private
  124.  
  125. expense, (b) is a trade secret of NeXT and its third-party
  126.  
  127. suppliers for all purposes of the Freedom of Information Act, (c)
  128.  
  129. is "commercial computer software" subject to limited utilization
  130.  
  131. as expressly stated in this Agreement, (d) in all respects is
  132.  
  133. proprietary data belonging solely to NeXT or third-party
  134.  
  135. suppliers, and (e) is unpublished and all rights are reserved
  136.  
  137. under the copyright laws of the United States.  The NeXT Software
  138.  
  139. is licensed only with "Restricted Rights" and use, reproduction or
  140.  
  141. disclosure is subject to restrictions set forth in Alternate
  142.  
  143. III(g)(3) of the Rights in Data - General clause at 52.227-14
  144.  
  145. (June 1987) and subparagraphs (a) through (d) of the Commercial
  146.  
  147. Computer Software - Restricted Rights clause at 52.227-19 (June
  148.  
  149. 1987) of the Federal Acquisition Regulations and their respective
  150.  
  151. successors. For units of the Department of Defense (DoD), this
  152.  
  153. NeXT Software is licensed only with "Restricted Rights" and use,
  154. duplication, or disclosure is subject to restrictions as set forth
  155.  
  156. in subdivision (c)(1)(ii) of the Rights in Technical Data and
  157.  
  158. Computer Software clause at 252.227-7013 (June 1988) of the DoD
  159.  
  160. Supplement to the Federal Acquisition Regulations and its
  161.  
  162. successors. Contractor/manufacturer is NeXT Computer, Inc., 900
  163.  
  164. Chesapeake Drive, Redwood City, CA 94063.

  166. 5  Entire Agreement.  This Agreement constitutes the entire
  167.  
  168. agreement between the parties with respect to the subject matter
  169.  
  170. herein.
